eference to Hongkong Ordinances instead of to English Acta, the

batitution of the Governor for the Board of Trade for certain

ministrative functions, and the substitution of the Custodiansof

nemy Property in Hongkong and in China for the Custodian in the

nited Kingdom.

As regards article 1(i) of the Order, providing for the estab-

lishment of a Clearing House in the United Kingdom, it was thought

better to insert a section in the Ordinance providing that a local

blearing office may be established in Hongkong.

Article 1(xvii) (b) of the order requires certain returns to be

ade to the Custodian within one month from the date of the commence-

tent of the Order. This clause 16 item 6 in the Schedule to the

Ordinance, and the time for furnishing the returns here has been

extended up to the 31st March, 1920.

Article 1 (xvii) (c) and (d), and article 1(xx) confer certain

powers on the Board of Trade. The schedule to the Ordinance sub-

stitutes "Governor" in all these three cases. It may be that the

substituted words should have been "Board of Trade or Governor of

the Colony of Hongkong", but it was assumed that these powers would probably be exercised in any event through the Governor.

7. In dealing with the definition of the term "Custodian" it was

thought necessary to refer to the Custodian of Enemy Property in Cuina in view of the provisions of Ordinance No. 12 of 1919.

In my opinion this is an Ordinance to which His Excellency the Governor may properly assent in the name of His Majesty and on Hie

behalf.
